Erasure of arrest records raises libel issue

A government agency may choose to expunge an arrest record but the arrested person should not be able to sue for libel or invasion of privacy if a newspaper continues to report on the arrest especially if the newspaper is careful to provide updates including any dropping of charges, argues Eugene Volokh in The Volokh Conspiracy.
