Position: The court should grant review and transfer the case back to the Third District Court of Appeal for a reasoned decision on an issue of first impression — whether the public has a right to disclosure of regulations governing its conduct in an accessible and transparent manner.
About the case: This is a California Public Records Act case brought by Public.Resource.Org., after the state Office of Administrative Law refused to provide a machine-readable copy of the California Code of Regulations in response to a records request. At issue is whether an agency can avoid its obligation to disclose public records because it chooses to house those records with a private entity. The Third District Court of Appeal summarily declined to review the case. “The issue of public access to law governing the public’s conduct deserves far more than the Court of Appeal’s summary denial,” FAC Legal Director David Loy wrote to the court.
