Nevada student wins round in off-campus speech case

A former Nevada high school basketball player won a ruling in state state district court July 3 allowing his lawsuit to proceed against his school administration for suspending him for the off-campus posting of a series of tweets attacking the coaching staff and athletic department officials. Juliano Rosario is suing for violation of his First Amendment rights. This is one of a number of recent cases concerning the reach of school officials in punishing off-campus speech. The Third Circuit U.S. Court of Appeals ruled in 2011 that not all off-campus student speech was protected under the First Amendment but that school authorities had to show that the speech caused substantial disruption in the classroom. (Wired, June 14, 2011, by David Kravets)
