Technology nudges Supreme Court toward greater transparency

Computer technology can now determine the identity of Supreme Court justices writing unsigned opinions. There were eight unsigned decisions last term, over 10 percent of the docket. The court has long resisted the broadcast of live sessions on such landmark occasions as their consideration of same sex marriage. (The Atlantic, January 20, 2016, by Adrienne LaFrance)

Adam Liptak, The New York Times, July 2, 2015, observed that the unsigned decisions invariably concern prisoners challenging convictions who lost or law enforcement officers accused of bad deeds who won. The unsigned opinions gives short shrift to issues that should be  decided more definitively.
