Gopher Media LLC v. Melone

With Davis Wright Tremaine, FAC filed an amicus brief in Gopher Media LLC v. Melone to defend longstanding Ninth Circuit precedent that the denial of an anti-SLAPP motion in federal court is subject to immediate appeal, as it is in state court, rather than at the end of the case. The right to immediate appeal is necessary to prevent crushing litigation costs from chilling freedom of speech when an anti-SLAPP motion is wrongly denied. The brief was joined by Yelp Inc. and filed in tandem with an amicus brief from Reporters Committee for Freedom of the Press arguing that the California anti-SLAPP statute should continue to apply in federal court.
