Letter: Ojai Officials Erred in Passing Ordinance that Compels Speech by Affordable Housing Developers

On January 11, FAC sent the letter below to the Ojai City Council and Mayor Betsy Stix urging them to amend an ordinance passed in November 2023 that violates the First Amendment by compelling developers of affordable housing to include a burdensome amount of information in every written communication to the public about a given project. The letter states: “For example, the Ordinance applies to an op-ed or letter to the editor in a local newspaper discussing public policy reasons to support a project, such as a shortage of housing and increasing rates of homelessness.” Our letter explains that the ordinance goes far beyond any lawful regulation of commercial speech.
